Ajeva, LLC. ("Ajeva") respects the privacy of its users and is committed to protecting it. Ajeva provides this Privacy Statement to inform its users of its privacy practices, the type of information collected, how Ajeva uses that information, and with whom Ajeva shares that information. This privacy statement covers the Ajeva website, Ajeva.com, and the web services provided by Ajeva. Ajeva’s website is structured so that users visit parts of the Ajeva website without revealing any personal information. For other parts, users must log in to obtain access. Ajeva makes this notice readily available on its home page and at the bottom of every Ajeva web page. Included below is information on Ajeva’s privacy practices concerning the following:

1. Types of information collected
 
Accessing the Website

Any user seeking access to the Ajeva Application or the Ajeva Suite of Software must complete a registration form. On the registration form, the user is required to provide contact information (name, address, email address) and may be asked for financial information (credit card, credit card number, and expiration date, and/or bank account information). The user may be asked for additional personal information as necessary based on the user’s account type. The sole purpose of obtaining this information is to facilitate the user’s ability to access the website and the services Ajeva offers.

 
Ordering Services

Users seeking to purchase services from Ajeva must complete an order form. On this form, the user must provider accurate billing information (name, shipping address) and financial information (credit card, credit card number, and expiration date and/or bank account information (as appropriate)). In addition, in some circumstances, Ajeva may request certain tax related information from users ordering services. This information is strictly used for billing and payment processing purposes. If Ajeva has billing problems, Ajeva may contact the user by any of the contact details provided.

 
Using the Service

All data submitted to the Ajeva website by a user, shall remain the sole property of the user, unless specifically notified in advance, or as noted in the user agreements. Ajeva collects information from its users at several points on its web site and via its Suite of Software. In order to commence data collection, the software requires the user to provide a “user ID” and a “password” that correspond to a Ajeva user account.

The Ajeva Time software while active (not suspended), collects a series of data, either continuously or by sampling at random or regular intervals. The data collected currently are the counts of keystrokes and mouse clicks together with time information about when these events happened, the top application title, captures of the computer screens attached to the computer, captures of the input available through the selected video source, and any other related items to aid in managing time logs for project work. This information is packaged and submitted at regular intervals to the Ajeva website, and is made available to user accounts that have (a) the same ’User ID’; and (b) permissions to access the data.

The Ajeva Time software is not collecting any kind of data while in private mode (suspended) nor does it transmit any information to the web site. There is absolutely no difference between completely terminating the software and suspending the software, other than resuming the software from a suspended mode is a one-click operation.

The Ajeva Application as part of its normal operation stores information about user attributes, user permissions, and user preferences, and maintains a long term log of the data collected by the client. The log is maintained for 1 year with the exception of the screen captures which are kept for 90 days. After 90, days the full captures are replaced with significantly reduced in size (thumbnails) counterparts. When a user requests the deletion of a portion of his log, any information that was collected during that time range becomes inaccessible to anyone other than Ajeva Data Administrators (CTDA). When an account administrator removes a user, all logs and information about it become inaccessible to anybody but CTDA. Similarly when an account administrator terminates the whole account, all data and logs about the account and its users become inaccessible. However, the data may continue to exist within tapes and other forms of storage which will be cleared up at the discretion of CTDA.

 
2. How Ajeva uses that information
 
Transactions

Ajeva uses personal information to provide its users with services and to help it better understand its users’ needs and interests. Specifically, Ajeva uses personal information to help users complete transactions or orders, to communicate with users, to provide service and support, and to update users on services and benefits. Credit card and/or bank account information is used only for payment processing and fraud prevention. Credit card and/or bank account information and sensitive personal data are not used for any other purpose by our financial services providers.

 
Communications

Occasionally, Ajeva may have to send service announcements to its users. For example, if the service is under maintenance, users will be notified by email. These communications are not promotional, they are only informational. In addition, Ajeva communicates with its users on a regular basis to provide requested services and to respond to user inquiries. Ajeva may also send notifications of actions on the Ajeva web site. Depending on the user’s preference, Ajeva may contact the user by phone or email.

 
User Comparisons

Additionally, as described above, Ajeva also collects information from its software to create comparative reports of users within the same company. These reports include records of a user’s activity while on Ajeva’s software. Ajeva compiles these reports into daily, weekly, and monthly views showing the activity among the users within the same company. As stated above, this information is available only to members of the company with the right to access such information.

 
3. With whom Ajeva may share information

Ajeva will not sell, rent or lease its users’ personal information to others. Ajeva will not share personal information with third parties except in responding to requests for products or services. Should such an occasion arise, Ajeva will request the user’s permission to share this information.

 

Ajeva will not share personal information with any other third parties without a user’s permission, unless to: (i) respond to duly authorized information requests of governmental authorities; (ii) comply with any law, regulation, subpoena, or court order, (iii) help prevent fraud or to enforce or protect the rights and properties of Ajeva or its subsidiaries; or (iv) to protect the personal safety of Ajeva employees and third parties on Ajeva property.

 

Circumstances may arise where, whether for strategic or other business reasons, Ajeva decides to sell, buy, merge or otherwise reorganize its business. Such a transaction may involve the disclosure of personal information to prospective or actual purchasers, or receiving it from sellers. It is Ajeva’s practice to seek appropriate protection for information in these types of transactions.

   
4. Personal information and third party companies
 

Ajeva uses a credit card/ACH processing company to bill its users for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes.

   
5. Keeping personal information secure
 

Ajeva is committed to protecting the information provided by its users. To prevent unauthorized access or disclosure, to maintain data accuracy, and to ensure the appropriate use of the information, Ajeva has in place appropriate physical and managerial procedures to safeguard the information it collects.

 
Credit Card / Bank Account Information

Ajeva uses Secure Sockets Layer (SSL) encryption when collecting or transferring sensitive data such as credit card information and/or bank account information. SSL encryption is designed to make the information unreadable by anyone but Ajeva Servers. This security measure is working when the symbol of an unbroken key or closed lock (depending on the browser) appears on the bottom of the browser window. Credit card information and bank account information are used only for processing payment and are not used for other purposes.

 
User Information

All of Ajeva’s users' information is restricted in the Ajeva Data Center. Only CTDA have access to the data in order to perform the necessary maintenance operations. Ajeva clearly separates all the information that is collected from its client software (which constitutes in terms of storage more than 99% of the data) and does not share that data with any other employee of the company, unless a user explicitly requests Ajeva to deal with a particular problem. The rest of the data (e.g., billing info, contact info etc) may be accessed by company employees as part of their normal job function (customer support, billing clerks, and salespersons). The servers that store personally identifiable information are in a highly secure environment.

   
6. Changes to this statement
 

If there are updates to the terms of Ajeva’s Privacy Statement, Ajeva will post those changes and update the revision date in this document. For material changes to this Statement, Ajeva will provide notification to affected users.
